Contracting entity. Kaller Nordic Trading AB, organisation number 559092-4055, trading as DryFireMag Europe (“KNT”, “DryFireMag Europe”, “we”, “us” or “our”).

Application. This Declaration applies to every person or organisation purchasing products from DryFireMag Europe, including consumers, businesses, public authorities, training providers, instructors, institutions and resellers (each a “Purchaser”). It forms part of the DryFireMag Europe Terms and Conditions. By placing an order through the website, selecting the required acceptance checkbox and submitting the order, the Purchaser confirms that the statements and undertakings below are accurate and binding.

Purchases for another user. Where the Purchaser is not the final user, the Purchaser must identify the intended end user, communicate the applicable restrictions to that end user and take reasonable steps to ensure that the products are used and transferred in accordance with this Declaration.

Purchaser undertakings

1 Identity of the purchaser and end user
The Purchaser will provide accurate and complete identification and contact information. Where the products are acquired for another person or organisation, the Purchaser will identify the intended final customer or end user and retain sufficient information to support appropriate customer and transaction checks.

2 Final destination
The Purchaser will provide the true final delivery destination and will not knowingly route an order through an intermediary, freight forwarder or alternative address for the purpose of concealing the final destination or end user.

3 Lawful intended use
The products will be acquired, used, marketed and, where applicable, supplied only for lawful, non-lethal training, simulation, education or skills-development purposes and in accordance with the product instructions.

4 No unauthorised export or transfer
The Purchaser will not export, re-export, resell, provide, lend or otherwise transfer the products outside an approved territory or to an unapproved party without all authorisations required by applicable law and, where applicable, the prior written approval of KNT.

5 No prohibited or sanctioned parties
The Purchaser will not acquire, use or supply the products for the benefit of a sanctioned person, prohibited organisation, blacklisted or restricted destination, or any other party or transaction prohibited by applicable law or KNT policy. The Purchaser must comply with the destination and end-user restrictions in Schedule 1.

6 Local legal and regulatory requirements
The Purchaser is responsible for confirming and complying with all laws, import requirements, registrations, permits, licences, customs rules and other regulatory obligations applicable to the purchase, possession, use, delivery, resale, export or transfer of the products in the relevant jurisdiction.

Compliance information and cooperation

The Purchaser must promptly provide accurate information reasonably requested by KNT to verify the identity of the Purchaser or end user, the intended use, the destination or the lawfulness of a transaction. Any personal data collected for these purposes will be handled in accordance with the DryFireMag Europe Privacy Policy and applicable data-protection law.

Schedule 1 Blacklisted destinations and restricted transactions

1. Prohibited destinations. As a matter of KNT policy, the Purchaser must not sell, deliver, export, re-export, transfer, make available or permit the use of products in, to, through or for the benefit of any of the following countries or territories. KNT will not accept or fulfil orders involving these destinations:

  • Afghanistan
  • Belarus
  • Cuba
  • Iran
  • North Korea (Democratic People’s Republic of Korea)
  • Russia
  • Syria
  • Crimea and Sevastopol
  • Non-government-controlled areas of the Donetsk, Luhansk, Kherson and Zaporizhzhia regions of Ukraine

2. Dynamic extension of the blacklist. The prohibition also applies automatically to any country, territory, region, person, organisation, entity, vessel or transaction that is subject, at the time of the order, shipment or transfer, to a comprehensive embargo, asset freeze, prohibition on making funds or economic resources available, or other restriction that prevents the transaction under applicable European Union, United Nations or Swedish law. Where relevant to the products or transaction, it also includes applicable United States export-control, sanctions and re-export restrictions and restrictions imposed by the manufacturer or supplier. The current official rules prevail over the examples listed above.

3. Restricted destinations and enhanced review. Any destination, end user or transaction subject to targeted sanctions, an arms embargo, sectoral restrictions, heightened diversion risk or licensing requirements is restricted and must not proceed without KNT’s prior written approval. KNT may require identification documents, an end-user certificate, an import permit, proof of intended use, ownership and control information, or other supporting evidence before approving the transaction.

4. Prohibited parties and conduct. The prohibition applies regardless of destination where the Purchaser, payer, consignee, intermediary, beneficial owner, end user or any other party is listed or owned or controlled by a listed party under an applicable sanctions regime. The Purchaser must not use third parties, false information, split orders, alternative payment routes, freight forwarders or transshipment points to evade screening, licensing, destination or end-use controls.

5. Professional and government end users. Orders intended for military, law-enforcement, intelligence, correctional, customs, border-control, private-security, firearms-training or firearms-dealer end users may be subject to enhanced due diligence and must be disclosed accurately. Such an order may not be placed or fulfilled where prohibited by law and may be held pending KNT approval and any required authorisation or end-user documentation.

Refusal suspension and cancellation

To the extent permitted by applicable law, KNT may request additional information, delay shipment, refuse or cancel an order, suspend an account or decline further supply where information is incomplete or inconsistent, or where KNT reasonably believes that the transaction or intended use may breach this Declaration, applicable law, sanctions, export-control requirements or KNT policy. This is without prejudice to any other rights or remedies available under the Terms and Conditions or applicable law.

Accuracy and continuing obligation

The Purchaser confirms that all information supplied in connection with the order is true, complete and not misleading. The Purchaser must notify KNT without undue delay if the intended end user, use or destination changes before delivery or any subsequent transfer. If this Declaration conflicts with another provision of the Terms and Conditions, this Declaration prevails only in relation to end-use, destination, transfer, sanctions and regulatory-compliance matters.

Good faith reliance and purchaser responsibility

KNT conducts such checks as it considers reasonable and acts in good faith on the basis of the information and documents provided by the Purchaser and any other parties involved in the transaction. The Purchaser remains responsible for ensuring that every statement, representation and document supplied in connection with the order is truthful, accurate, complete, current and not misleading. Any screening, enquiry, acknowledgement, approval or fulfilment of an order by KNT does not relieve the Purchaser of that responsibility. To the extent permitted by applicable law, the Purchaser is responsible for the consequences of any false, inaccurate, incomplete, outdated or misleading declaration or omission.

Acceptance

Before an order can be submitted through the DryFireMag Europe website, the Purchaser must actively select the acceptance checkbox displayed during checkout. The checkbox must not be pre-selected. By selecting it and submitting the order, the Purchaser confirms that it has read and understood this Declaration and the DryFireMag Europe Terms and Conditions and agrees to be legally bound by them. The electronic acceptance forms part of the order record.

I confirm that I have read and accept the DryFireMag Europe Terms and Conditions and the Purchaser and End User Declaration, including the end-use, destination, sanctions and transfer restrictions.
